Trust & Estates

Estate Planning: Our attorneys work with clients to set up an estate plan that will ensure that their wishes are carried out and that assets are effectively preserved and protected from avoidable estate tax. The planning includes directing the disposition of assets upon death, establishing who will make financial and medical decisions in the event of disability and, if applicable, directing who will be the guardians of minor children. If the plan requires asset transfers, our staff will insure that the transfers are done in a timely manner. If illness or incapacity prevents a client from traveling to our office, we will accommodate the client. Our No-Fee annual review will insure that the plan has been correctly implemented and will prompt the clients to revisit the goals, in light of any changes in the law.

Estate Administration: From inception through distribution of assets to beneficiaries, our attorneys advise fiduciaries on the many legal issues that arise during the administration of a trust or estate, including probate and administration proceedings, gathering and preserving estate assets, estate and trust tax issues, estate and trust accountings and proper distribution of assets to beneficiaries and any litigation that may arise during the administration of the estate. Our supportive staff insure that our clients' needs and concerns are addressed in a professional, timely and compassionate manner.

Estate Litigation: The process of distributing an estate can be a confusing, emotionally charged time. The proper legal guidance is essential to protecting one's rights. Our attorneys have considerable experience in a wide range of litigated estate matters, as well as an all-important familiarity with the Surrogate's Court. Craco & Ellsworth can offer assistance with all facets of estate litigation, including disputes over closely-held businesses, litigation over the conduct of executors, administrators and trustees, will contests and contested gift cases.
